Conditions of Sale
The purpose of these general conditions of sale is to regulate the purchase of products and services, made at a distance and made available, via the Internet, from the site www.oliomemento.it (hereinafter, the Site) in compliance with Italian legislation on distance contracts (Legislative Decree 70/2003 et seq.). The site is the property of Alessandro De Marco, who grants its use to the company Make More Srl Unipersonale. The Customer is obliged, before sending the order, to read carefully the General Conditions that have been made available to him on the Site to enable him to reproduce and store them. A Customer who makes purchases requiring the issuance of an invoice and/or who is otherwise not a "consumer" within the meaning of Article 3, paragraph 1, letter a) of the Consumer Code, shall not be entitled to the provisions relating to withdrawal as hereinafter as applicable under the same Code to "consumers". Contracts concluded with MAKE MORE SRL UNIPERSONALE through the Site are governed by these General Conditions in accordance with Italian law. Choosing and Ordering Products To purchase Products, the Customer must complete and submit the order form in electronic format, following the instructions on the Site. The Customer must add the Product to the cart and, after reviewing the General Terms and Privacy Policy, must enter the shipping and billing information, select the desired payment method, and confirm the order. The confirmation has the value of a contractual proposal, the Customer acknowledges and declares that he/she has read all the information provided to him/her during the purchase procedure and fully accepts these transcribed General and Payment Conditions. The contract entered into between MAKE MORE and the Customer shall be deemed concluded with the acceptance, of the order by MAKE MORE. Such acceptance is communicated to the Customer through an email Confirmation of the order itself. If the Customer is an end-consumer (i.e. a natural person purchasing the goods for purposes not related to his or her professional activity), once the online purchase procedure has been completed, he or she will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of Italian legislation on distance contracts. Product Information The visual representation of products on the Site, where available, normally corresponds to the photographic image accompanying the description sheet. It is understood that the image of the products themselves is for the sole purpose of presenting them for sale and may not be perfectly representative of their characteristics but differ in color and size. In case of any difference between the picture and the written product sheet, the product sheet description always prevails. Prices There is no minimum order to proceed with the purchase of products. The prices of the same are inclusive of all taxes and fees and are in Euros. Shipping to Italy Shipping is free for orders over € 99.00; for lower amounts the shipping fee is € 7.50. Shipments Abroad Shipping is free for orders over € 199.00; for lower amounts the shipping cost is € 16.00 for intra-EU deliveries. Methods of payment The Customer may make the payment of the price of the Products and related delivery charges by: Credit Card, PayPal and bank transfer. Credit Card The circuits on which you can purchase within the Site are:Visa, Mastercard;American Express. To ensure maximum security, the Customer will make the payment transaction directly on the bank's secure server. The Site does not store the Customer's credit card number. The Referring Credit Institution uses the SSL protocol to encrypt data transmitted between its server and the Client's browser. PayPal Once the order is confirmed, the Customer will be redirected to the PayPal site where he/she can make payment with his/her account or by using a card, including a prepaid card. Bank Transfer Transfer details. Reason: the Customer must indicate in the reason for the transfer the transaction data received by email with the order confirmation. Confirmation of receipt of order Once the order is received, MAKE MORE will check stock availability for order fulfillment. In the event that a product is out of stock, MAKE MORE Customer Service will promptly notify the Customer. The Customer can decide whether to confirm the shipment or cancel it. The Customer receives, upon execution of the contract, an email confirming receipt of the submitted purchase order. The notice contains a summary of the general and special conditions applicable to the contract, the withdrawal, the order number, a summary of shipping (and any transportation costs) and billing information, a list of the products ordered with their essential characteristics, their price, the amount paid and the expected delivery date. Transportation and delivery Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase process. Any delivery charges are the responsibility of the Customer and are separately highlighted during the purchase process. MAKE MORE will send the Customer a confirmation email once the Products have been shipped, which will include a link to refer to for tracking the shipment. In any case, except in cases of force majeure or unforeseeable circumstances, the Products ordered will be delivered, in Italy or in the EU (at street level), within a maximum period of 10 (ten) working days from the day after the day on which the Customer has transmitted the order to MAKE MORE, unless the latter communicates, within the same period, the impossibility of delivering the ordered goods due to the unexpected unavailability, even temporary, of the Products. In case of such communication, the Customer will have the opportunity to choose one or more alternative products. In the event that the Customer decides not to choose Alternative Products or to cancel the order, MAKE MORE will refund any sums already paid by the Customer within the same time limits. Active delivery services in Italy The delivery service is entrusted to Mail Boxes Etc. Right of withdrawal The Customer has the right to withdraw from the purchase contract for any reason whatsoever, without the need to provide explanations and without any penalty, subject to the cases of exclusion provided for in paragraph D below. To exercise this right, the Customer must send MAKE MORE a notice within 14 days from the date of receipt of the Products by sending a registered letter A/R, addressed to:

MAKE MORE will, once received the communication, open a file for the management of the return and communicate to the Customer the instructions on how to return the Products, which will be done by courier indicated by MAKE MORE. The right of withdrawal is governed by the following conditions: The right applies to the Product purchased in its entirety; therefore, if the Product is composed of several components or parts, it is not possible to exercise withdrawal only on part of the Product purchased. In case of exercise of the right of withdrawal MAKE MORE will refund the customer the full amount of the returned goods, except for shipping costs where applicable which will remain the responsibility of the Customer, within 14 days from the date on which the return of the goods was actually received by MAKE MORE. The refund will be made using the same method of payment used by the Customer, unless the Customer has expressly requested a different method. In case of bank transfer or cash on delivery payment, it will be the Customer's responsibility to provide the bank details on which to obtain the refund (account holder, name and address of the Bank and IBAN). Also in order to be able to guarantee free return under the following article, the Products must be returned, undamaged, sealed and without any signs of tampering, in the same box in which they were received. In addition to the cases mentioned in the Foreword (non-consumer customer and/or requesting invoice), the right of withdrawal is excluded, according to Art. 59 d.lgs 21/2014, for Products that are likely to deteriorate or expire rapidly and for sealed Products that are not suitable to be returned for hygienic or health protection-related reasons or that have been opened after delivery. With reference to the cases of exclusion of withdrawal listed above, the Customer, in particular, is informed and accepts that the Products that are "likely to deteriorate or expire rapidly" include all food products (including wines, oil, spirits and beverages) since the characteristics and qualities of these types of Products are also subject to alteration as a result of inappropriate storage. Therefore, for reasons of hygiene and protection of Customers, the right of withdrawal is applicable only for Products purchased on the Site that can be returned to MAKE MORE and that it can put them back on the market without danger to the health of consumers. Compliance defects In case of conformity defects in the sold Products, the Customer shall immediately contact MAKE MORE at&. email address: memento@oliomemento.it. The legal guarantees provided for in Articles 129, 130 and 132 of the Consumer Code apply to the sale of the Products. The Customer has the right to restoration, without charge, of the conformity of the goods by repair or replacement or to an appropriate price reduction or termination of the contract. The Customer forfeits these rights if he/she does not report the lack of conformity to MAKE MORE within two months from the date he/she discovered the defect. Errors The information about the Products provided through the Site is constantly updated; however, it is not possible to guarantee that it is completely error-free. MAKE MORE reserves the right to correct errors, inaccuracies or omissions even after an order has been submitted, or to change or update information at any time without prior notice. Applicable law and jurisdiction The contract of sale between the Customer and MAKE MORE is concluded in Italy and governed by Italian Law. For the resolution of civil and criminal disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the court of reference of his or her municipality of residence or elective domicile if located in the Italian territory; in all other cases, the territorial jurisdiction is exclusively that of the court of Venice.
